Sandwell Council has published the Wragge Report after two days of High Court drama.

Sandwell Council’s chief executive Jan Britton confirmed two reports have been published.

He said: “The first report is the findings of an independent investigation by solicitors Gowling WLG (formerly Wragge & Co). The second report is the legal opinion on Gowling’s findings, which the council sought from Mr James Goudie QC.

“Both reports are being published in the public interest and to show the seriousness and thoroughness with which Sandwell Council has investigated the allegations and in the interests of complete openness and transparency.

“The Gowling WLG report is the result of a very long and complex investigation. The serious nature of these allegations, which led to a separate police investigation, meant the council appointed an external firm to undertake an independent audit.

“The council then took further legal advice on the findings of the Gowling report and the nature of its publication.

“Today’s release of both reports stems from serious allegations made in late 2014 relating primarily to a small number of property sales and other matters. These allegations were taken very seriously.

“West Midlands Police announced in April 2016 its investigation had come to a close with no further action being taken against any individuals. This allowed the Gowling report to be brought to its conclusion.

“Sandwell Council then took QC’s advice which clearly recommended both the report and his independent legal opinion should be published.

“Today’s publication of both reports shows the absolute determination of Sandwell Council to deal with these allegations properly, professionally and appropriately.

“It shows our commitment to investigate the allegations and to deal with them in accordance with the council’s codes of conduct for members and officers, and all of the council’s standing orders.

“It also shows we have not swept matters under the carpet and that there was absolutely no wish to do so.

“The next step is for a referral to the council’s standards committee which considers the conduct of elected councillors and deals with allegations of misconduct.

“The council’s audit committee will also be asked to consider financial and procedural aspects of the reports. This will include a review of action that has already been taken to tighten up council procedures on land sales.

“The council will also consider if any disciplinary action against employees is required.”
