THE heartbroken family of a schoolboy who died after he was struck by a lorry in Oldbury have held a protest calling for ‘answers’ into his death.

Around 40 friends and family of Kyle Bastable protested on Sunday near the site of his tragic death, holding ‘justice for Kyle’ and ‘we want answers’ banners.

The 11-year-old, of Rowley Regis, died near to the Shell garage on Birchley Island after being hit by a HGV before 10pm on August 31 last year.

An inquest into the former Rowley Hall Primary School pupil’s death heard Kyle – also known as Joe - died as a result of multiple fatal crush injuries.

Tachograph data collected from the lorry indicated the vehicle was travelling at 35mph in the 40mph zone and then decelerated to 22mph within five seconds as it passed the Wolverhampton Road junction.

The lorry sharply decelerated to 17mph, then slightly accelerated to 19mph, before coming to a halt in Churchbridge.

The driver said he slowed down to avoid Kyle’s friend, who was travelling on a bike, but did not see Kyle.

The family later sent a letter to Chief Inspector Kevin Mulligan calling for a review into his death, and protested for two hours on Sunday to drum up support.

Grandmother Susan Bastable said: “It went peacefully. It went well.

“We got a lot of support from the public. We had a lot of support around the island from other car users and they were shouting that we were doing the right thing.

“We want a full investigation into the officers and a full investigation into his death.

“I am not saying that the driver is in the wrong. But we want answers into why all the information has not been given. We really need somebody out there to help.”

In a letter to the family, DI Mulligan said that there is nothing to alter the original decision of the driver not being culpable for any criminal offences, and added the investigation was fair, balanced and proportionate.

A West Midlands Police spokesman added: “A detailed investigation was undertaken by the Serious Collision Investigation Unit followed by a comprehensive review at the request of the family under the victim’s Right to Review.

“The conclusion of both reports, having taken into account all the circumstances, was that the collision was sadly unavoidable.

“Our sympathies remain with Kyle’s family and friends after their tragic loss.”
