A BID to build a detached house in Halesowen has been dropped after objections.
The application for a three-bedroom detached house in Furnace Hill had been put to Dudley Council.
The council's tree officer objected to the plan, opposite Our Plaice Fish and Chip shop, saying that "the information submitted as part of this application is insufficient to demonstrate that
there would be no harm to the protected oak tree as a result of the proposed development."
A neighbour also objected citing concerns over drainage.
The site had permission for a home to be built, but the planning permission has now expired.
The tree officer stated in a report that the new home would put "undue future pressure on the protected tree to be pruned in order to prevent any encroachment over the roofline, or to improve the quality of internal and external amenity space that would be shadowed."
The neighbour, who has lived in the area for 40 years, stated: "There has always been an issue with excess surface water draining from the highway onto the footpath and down my driveway, with large puddles of water gathering at the entrance to my house.
"Currently, the land which this proposed dwelling will be sited acts as a drainage and absorption area for a considerable amount of the excess surface water.
"I am concerned that the proposed development without significant drainage included would make the issue with surface water outside my property and on my driveway worse."
The site is on land next to 2, Furnace Hill.
