A HALESOWEN man has been given a suspended prison term after an accident happened while he was drink driving.

Gary Marshall, of Intended Street, admitted driving a Fiat Punto on Waterfall Lane, Cradley Heath, while over the legal limit on July 7, when an accident occurred.

The 50-year-old had consumed so much alcohol that the proportion of it in his breath (namely 128 microgrammes of alcohol in 100 millilitres of breath) exceeded the prescribed limit, court documents stated.

He was committed to prison for eight weeks suspended for 24 months.

Court documents state that the reason for the prison sentence was that it was a "very high reading" and that an "accident occurred."

Marshall was also disqualified from driving for 30 months, fined £350, and ordered to pay £135 costs and a £154 surcharge to fund victim services when sentenced at Dudley Magistrates' Court on July 26.

He was also ordered to participate in alcohol treatment for 90 days.
